Cherry Hill Bike Accident Attorney

Bicycle accidents can happen quickly, and the injuries sustained from these accidents can be life-altering. Even though you may take every safety precaution, riding your bike on the roadway can be dangerous. New Jersey law affords bicyclists the same rights on the roadway as a motor vehicle driver (NJSA 39:4-14.1), but motor vehicle drivers do not always adhere to these rules. Distracted driving, passing too closely, inattention, or other driver negligence can cause a serious accident between a vehicle and your bicycle. We know that accidents can be stressful, especially if you are unable to work and have medical bills piling up. Let us help you get the compensation you deserve while you focus on healing.

Basics Of The Safe Passing Law

New Jersey law helps protect the safety of bikers through the Safe Passing Law (NJSA 39:4-92.4). The Safe Passing Law provides requirements that motor vehicles must adhere to as they pass pedestrians, bicycles, low-speed electric scooters, or other lawful personal conveyances. If possible, the motor vehicle should make a lane change into a lane not adjacent to the biker. If a lane change is not possible, the motor vehicle should leave a safe space of at least four feet during passing. Finally, if there is not enough room to safely leave the four-foot distance, the motor vehicle should slow to 25 miles per hour and only pass if the conditions allow for passing the bike safely.

Penalties for breaking this law include fines and potential motor vehicle penalty points. Additionally, the motor vehicle driver will likely be liable directly to the injured party for any damages or injuries sustained.

What To Do After A Bike Accident

The moments immediately following a bike accident can be frightening. First, you should always take care of any immediate medical needs. If possible, obtain contact information for any eyewitnesses. Witness testimony may be needed later in the claims process. Gather the motor vehicle driver’s information, such as their name, address, tag number, and insurance information. You will likely need to call the police so that they can create a report. Consider taking some photos of the area where the accident occurred to help preserve evidence. Finally, talk to an experienced bike accident attorney who can help you assess your claim and get the compensation you are owed.
